summer semester 2021 | Last update: 16.06.2021 | Place course on memo listUnderstanding of the law of international commercial arbitration and ability to work with the UN Convention on Contracts for the International Sale of Goods (CISG). Improving research and writing skills with international materials necessary to the presentation of arguments in international arbitration.
Participants will also be prepared to take part in the Vis Moot Court in Vienna 2020/2021 as a team of the Innsbruck faculty of law.
"Advanced International Commercial Arbitration Practice"
The course will cover basic aspects of the law of international commercial arbitration. After an introduction into the subject (concept and juridical nature; types; regulatory framework) state regulation of international arbitration is discussed on the basis of the UNICITRAL Model Law. Then rules for the determination of the applicable law are presented, supplemented by an overview of relevant international and non-state rules like the CISG and the UNIDROIT PICC. The drafting of arbitration agreements is explained, followed by an analysis of procedural questions. Also, the possibilities to challenge an arbitral award before a state court and the ways to enforce an award are presented. Finally, students will be introduced to the drafting of submission in international arbitral proceedings.

Lecture with discussion of case law.
Written exam at the end of the course.

Good knowldege of contract law; thorough proficiency of English language

Course starts in the second half of the semester (block teaching from the end of April to June - 6 blocks with 5 x 45 min).
