winter semester 2021/2022 | Last update: 19.11.2021 | Place course on memo listThis lecture develops the student's ability to evaluate the role that the law has in regulating professional and recreational sport, in the law relating to associations and to liability issues. This role of the law will be viewed within the social and cultural context of sport. A range of issues will be examined and students will be able to understand the role that law plays along side 'sporting rules' within a wide regulatory framework.
An understanding of the key concepts, principles and issues relating to sporting activity;overview of regulatory framework for sporting activity in Austria as well as internationally. Emphasis will be on identifying the complexities around regulation over arrange of sports-related issues.
Finishing the course students should be able to demonstrate knowledge of specific components of sports management such as fundraising, sponsorship, event management, and health and wellness.
Sports law - Law of Associations - Liability law (selected topics)
Increasing professionalisation, the enormous growth in the Olympic Movement and the commercialisation of sport have all contributed to the development of Sport as a business, as well as a pastime. As a result there has been increasing intersection of the law with sporting activity. This course will examine the following:
- Introduction – Regulating Sport and Sports Autonomy
- the structure of sporting organisations and associations
- International and national governance of sport
- The impact of intellectual property laws on sponsorship and promotion of sporting events
- the role of sport rules
- Arbitration in Sport and Court of Arbitration for Sport (CAS/TAS)
- Anti-Doping
- Commercial Rights & Interests in Sport
- Commercial Integrity in Sports events
- The European Union Influence on Professional Sport
- Liability in the field of sport
Lecture, analysing original documents and discussions
Most likely written exam at the end of the course, potentially oral instead (stated during course of the lecture)
Lecture will be given in German language. Some of the original documents will be in English language.
