- Students know the current legal framework concerning the digital elements in proceedings.
- They are aware of future developments towards a digital civil proceeding.
The course provides an overview of the digitalization of civil proceedings. It will focus on the digital elements that already form part of civil proceedings. It will also examine which reforms towards a purely digital civil process can be expected in the future. The legal problems that digitalization entails (ensuring easy access to justice, preserving the principle of publicity etc.) will also be addressed. The course focuses mainly on the legal situation in Austria (e. g. Elektronsicher Rechtsverkehr, Online-Eingaben). However, the course will also shed light on the digitalization projects in other EU Member States as well as on the legal implications of EU law (directives and regulations as well as requirements of the ECJ).
