Substantive and practical knowledge of private insurance law.

Insurance aims at coping with (economic) risks by spreading and thus plays a central role in business. Correspondingly, more than a third of all civil law cases also tackle insurance law issues. Austrian insurance contract law has been codified in a specific statute ("VersVG") and differs from general contract law in important details that are explained and exemplified in this course. Among the topics presented you will learn about formation (including the rules on "insurance distribuition" by incurance intermediaries) and contents of insurance contracts  in general and with reference to special branches (like fire or liability insurance and life assurance), the parties' rights and duties (with regard e.g. to "Obliegenheiten" and special premium payment rules), handling of insurance claims, end of contract; but also issues of state control of insurance business and international aspects.

Lecture with power-point slides; questions and discussions welcome. 

Written test; mandatory attendance.

Legal texts (e.g. Kodex Versicherungsrecht or printouts from OLAT); textbooks and technical literature presented in one of the first units.

Basic knowledge of contract law and tort law;
attendance of all course units mandatory.

Please note that the subject "Zivilrecht und Recht der unternehmensbezogenen Geschäfte" requires positive marking of the lecture "Privatversicherungsrecht" as well as another course (e.g. Moot Court).
